Triangular Relationship & Workplace Resolution Policy

(Agency – Facility – Employee | W-2 Model | New York State)

Effective Date: January 1, 2026

This Triangular Relationship & Workplace Resolution Policy explains the professional, contractual, and employment relationship between 3B Elite Healthcare Staffing (“Agency”), the healthcare Facility (“Facility”), and the assigned healthcare professional (“Employee”) operating under a W-2 employment model in accordance with New York State and federal law.

3B Elite Healthcare Staffing is committed to providing a professional, respectful, and safe work environment for all healthcare professionals and facility partners. We maintain clear policies to ensure fair treatment, effective communication, and prompt resolution of workplace matters.

1. Employment Relationship (W-2 Model)

All healthcare professionals placed by 3B Elite Healthcare Staffing are W-2 employees of the Agency, not independent contractors.

Agency Responsibilities

  • Payroll processing and tax withholding
  • Workers’ compensation insurance coverage
  • Employment classification and labor law compliance

Facility Responsibilities

  • Clinical supervision and patient-care oversight
  • Daily operational direction and scheduling
  • Unit-specific policies, procedures, and workflows

Employment Relationship Clarification

Nothing in this agreement creates an employment relationship between the Employee and the Facility. The Employee remains solely employed by 3B Elite Healthcare Staffing at all times.

2. Roles & Responsibilities

Agency Responsibilities

  • Manage credentialing, compliance verification, and onboarding
  • Handle employment administration and payroll processing
  • Coordinate assignments and maintain clear communication
  • Provide employment guidance and assist with conflict resolution

Facility Responsibilities

  • Maintain a safe, compliant, and professional work environment
  • Provide orientation, unit-specific policies, and role expectations
  • Offer clinical supervision and performance-related feedback
  • Report concerns or issues promptly to the Agency

Employee Responsibilities

  • Adhere to facility policies, procedures, and scope of practice
  • Maintain professional conduct at all times
  • Communicate concerns clearly, promptly, and respectfully
  • Comply with all New York licensing, labor, and healthcare regulations

3. Workplace Conduct & Professional Standards

Employees are expected to:

  • Maintain respectful and professional communication
  • Work collaboratively with facility leadership and permanent staff
  • Follow the established chain of command
  • Avoid workplace disruption, insubordination, or unprofessional behavior

Harassment, discrimination, retaliation, or unsafe conduct will not be tolerated.

4. Conflict Resolution Process

When issues arise involving:

  • Employee and Facility leadership
  • Employee and permanent Facility staff
  • Employee and operational or performance expectations

Resolution Process

  • Immediate Reporting: The Employee must promptly notify 3B Elite Healthcare Staffing.
  • Agency Review: The Agency will review the concern and communicate with the Facility.
  • Collaborative Resolution: The Agency may mediate, clarify expectations, or implement corrective actions.

Outcome Determination

Outcomes may include:

  • Continuation of assignment
  • Reassignment
  • Corrective action
  • Assignment termination

Employees should not attempt to resolve serious disputes independently without Agency involvement.

5. Assignment Termination

Assignments may be ended by:

  • The Facility, with notice when possible
  • The Agency
  • The Employee, with reasonable notice

Grounds for termination may include:

  • Policy violations
  • Performance-related concerns
  • Behavioral issues
  • Safety or compliance risks
  • Facility operational changes

Termination of an assignment does not guarantee reassignment and does not change W-2 employment status.

6. Permanent Hire & Non-Solicitation

Employees may not accept permanent employment with a Facility without prior written approval from 3B Elite Healthcare Staffing, in accordance with contractual agreements and New York employment law.

7. Legal & Regulatory Compliance (New York)

This policy aligns with and complies with:

  • New York Labor Law
  • New York Department of Health regulations
  • Federal employment and wage laws
  • Healthcare credentialing and patient safety standards

8. No Medical Authority

3B Elite Healthcare Staffing does not provide medical care or make clinical decisions.

All clinical judgment and patient-care decisions remain the responsibility of licensed healthcare professionals and the Facility.

9. Policy Updates

This policy may be updated to reflect changes in:

  • New York laws
  • Healthcare regulations
  • Facility requirements
  • Employment standards

Continued employment constitutes acceptance of the current policy.

Issue Resolution & Grievance Procedure

If a workplace issue or concern arises during an assignment, we encourage prompt reporting to ensure a fair resolution. The following steps should be taken:

  1. Internal Facility Resolution: Where appropriate, attempt to resolve minor clinical or operational matters directly with the facility supervisor or department lead.
  2. Reporting to 3B Elite: If the matter remains unresolved or involves safety, harassment, or contractual concerns, contact 3B Elite Healthcare Staffing leadership immediately.
  3. Investigation: 3B Elite will review the concern, which may involve consultation with facility leadership, to reach a fair and objective resolution.

Drug-Free Workplace

To ensure patient safety and professional integrity, 3B Elite Healthcare Staffing maintains a drug-free workplace policy. Professionals may be subject to pre-employment, random, or for-cause drug screening as required by facility policies and regulations.
